    RESOLUTION No. 10.12.04
    RESOLUTION ORDERING THE REPAIR OR REMOVAL OF A HAZARDOUS BUILDING UNDER MINNESOTA STATUTE 463.15 to 463.61, IN THE MATTER OF HAZARDOUS BUILDING LOCATED AT 300 THIRD AVE. NORTH, ST. JAMES; MINNESOTA. LEGALLY DESCRIBED AS: PARCEL NUMBER: 20.276.2230, LEGAL DESCRIPTION: W 75' OF N 1/2 OF LOT 11 AND W 75' LOT 12 BLOCK 080 OF FIRST ADDITION.
    TO: OWNER OF RECORD
    1. Pursuant to Minnesota Statutes, Section 463.15 to 463.61 the Council of the City of St. James, duly considered the matter, finds the above buildings to be hazardous for the following reasons:
    a. The building has not been maintained and is to a point where it is unsafe. The dwelling as it sits today is enforceable under Minnesota Statute 463.15.
    b. The dwelling has a roof that has started to fail due to the lack of maintenance.
    c. The siding has started to fail due to lack of maintenance by the owner.

Pursuant to the forgoing findings and in accordance with Minnesota Statutes, Sections 463.15 to 463.261, the council hereby orders the record owners of the above hazardous building to repair or raze such building in order to a safe environment and not detrimental to the public health, welfare and safety.
    a. The City of St. James Building Official has made recommendation that the building be repaired or razed to protect the health and safety of the public.
    b. The City of St. James acknowledges that the City has been unable to make the owners of record to make the repairs.
    c. The City of St. James acknowledges that at this time no effort has been made to make any repairs to correct the unsafe and hazardous conditions. The Building Official inspected the property on August 30, 2012.
    d. The City of St. James acknowledges the dwelling is not occupied.
    3. The council further orders that unless such corrective action is taken or an answer is served upon the City of St. James and filed in the Office of the Clerk of District Court of Watonwan County, Minnesota within 20 days from the date of the service and order, a motion for summary enforcement of this order will be made to the District Court of Watonwan County.
    4. The council further orders that if the city is compelled to take any corrective action herein, all necessary cost expended by the city will be assessed against the real estate concerned and collected in accordance with Minnesota Statutes 463.22.
    5. The mayor, city attorney, and other officer and employees of the city are authorized and directed to take such action, prepare, sign, and serve such papers as are necessary to comply with this order and to assess the costs thereof against the real estate described above for collection along with taxes.

    MINNESOTA DEPARTMENT OF NATURAL RESOURCES
    NOTICE OF HEARING ON SALE OF STATE LAND
    NOTICE IS HEREBY GIVEN, that pursuant to Minnesota Statutes, section 97A.135, subd. 2a, a hearing will be held by the Department of Natural Resources, in the conference room at the Watonwan County Human Services Building, Community Room located at 715 2nd Avenue South in St. James, MN, on November 27, 2012 at 11:00a.m.
    The purpose of the hearing is for public input regarding the sale of 99.75 acres of state land situated in the County of Watonwan, and described as:
    In Township 105 North, Range 32 West of the Fifth Principal Meridian:
    A strip of land 100 feet in width extending over and across the East Half of the Northwest Quarter of Section 3, said strip of land being 50 feet in width on each side of the center line of the main track (now removed) of the Minneapolis and St. Louis Railway Company (now and Chicago and North Western Railway Company), as said main track center line was originally located and established over and across said Section 3.
    Page 3 of 6 - ALSO: A strip of land 100 feet in width extending over and across the Southwest Quarter of said Section 3, said strip of land being 50 feet in width on each side of said original main track center line.
    EXCEPTING THEREFROM:
    That part lying between the Easterly extension of the North line of Main Street in Echols, and a line drawn at right angles to the Southeasterly line of Railroad Avenue at a point thereon distant 575 feet Southwesterly from its intersection with said Easterly extension of the North line of Main Street.

    ALSO: A strip of land 100 feet in width extending over and across the Northeast Quarter, and the West Half of the Southeast Quarter, of Section 27; the West Half of the Northeast Quarter, the Southeast Quarter of the Northwest Quarter, and the East Half of the Southwest Quarter, of Section 34, said strip of land being 50 feet in width on each side of said original main tract center line.

    Minnesota Statutes, section 97A.135, subd. 2a, requires that a public hearing be held before lands within a Wildlife Management Area can be disposed of through sale or exchange. The parcel is designated as part of Watline Wildlife Management Area.
    It is proposed that this parcel of land be offered for sale by the Department of Natural Resources in a private sale to Watonwon County for development of a public trail. This parcel is no longer needed for resource management purposes. The land will remain open for hunting and trapping with further information on the deed restrictions provided at the hearing. If, after public hearing, the disposal of the land is in the public interest, the Commissioner of Natural Resources may vacate the parcel from Wildlife Management Area designation.
