    To the District Court above named the State of Minnesota brings this Petition and respectfully states and alleges:
    I.
    That Trunk Highway numbered 60, being Route numbered 16, has been located according to law and passes over the lands herein described.
    That it is duly covered by Right of Way Plat Orders numbered 92992, 92994 and 92996.
    II.
    That the Commissioner of Transportation deems it necessary that the State of Minnesota for trunk highway purposes obtain the lands herein described in fee simple absolute, and, as to Parcel 200, an easement in the lands herein described, together with the following rights:  to acquire all trees, shrubs, grass and herbage within the right of way herein to be taken, and to keep and have the exclusive control of the same; to acquire from the owners whose lands front thereon any existing right of access to said highway in those cases which are herein particularly mentioned; to acquire a temporary easement in those cases which are herein particularly mentioned.
    It is the intention of the above-named petitioner to move the court for an order authorizing the Court Administrator to accept and deposit in an interest bearing account payments from the petitioner to the court pursuant to Minnesota statutes.
    Further, it is the intention of the above-named petitioner to move the court for an order transferring title and possession of the parcels herein described, prior to the filing of an award by the court appointed commissioners, pursuant to Minnesota Statutes §117.042.
    The petitioner reserves its right to recover costs of clean up and testing and all other damages arising from the presence of pollutants, contaminants, or hazardous materials on the property described herein, from all potential responsible parties, including respondents herein where appropriate, in a separate legal action to the extent permitted by law.

    AN ORDINANCE AMENDING THE LEWISVILLE CITY CODE 61
    BY ADDING SECTION 61B ESTABLISHING
    A SEWER AVAILABILITY CHARGE (SAC)
    THE COUNCIL OF THE CITY OF LEWISVILLE DOES ORDAIN:
    SECTION ONE. That the Lewisville City Code be amended by adding the following:
    Section 61B, Sewer Availability Charge (SAC)
    Charge Established. For the purpose of providing funds for the city’s waste water treatment, force mains, lift stations and sewage collection systems, and the plant and facilities connected therewith, and the payment of capital charges represented by bonds, certificates of indebtedness or otherwise, which may be used to finance the costs of additions or expansions to the facilities, and the payment of reasonable requirements or reserves for replacement in obsolescence thereof, there is hereby imposed upon each lot, parcel of land, building or premises having any connection with the City’s public sewer system a sewer availability charge (SAC) as hereinafter provided. Said charge shall be in addition to any other previous or future charge or assessment levied against the property.
    Determination And Administration Of Charge. The availability charge as hereinabove authorized shall be imposed in addition to the user charges for sewer service and shall be determined and administered as follows:
    Subdivision. 1. Payment Required:
    a) Payment Required Prior To Connection: Prior to the issuance of the applicable permit and before connecting to the City’s sewer system, a City sewer availability charge as hereinafter provided for shall be paid.
    b) Additional Building Permit: If, after the initial availability charge is paid, an additional building permit is issued, the use of the property changes, or new sewer connection is made, the availability charge shall be recalculated and any additional charges shall be paid.
    c) Change By Resolution: Any change in the City sewer availability charge, as hereinafter set forth shall be by Council Resolution.
    Page 12 of 13 - Subd. 2. Determination Of Charge. The amount of the availability charge shall be determined by the City by first determining the number of Equivalent Residential Connections (ERC’s) applicable to the particular property. This charge shall be calculated in accordance with the most current ERC Table on file in the office of the City Engineer. Once the appropriate number of ERC’s are determined in this manner, the availability charge shall be calculated using the charge in the most recent resolution setting the availability charge. The availability charge shall be $35.00 per month with a usage charge of $5.35 per thousand gallons used.
    Subd. 3. Determination Of ERC’s. The City shall determine the number of ERC’s.
    Subd. 4. Transfer of ERC’s. Once established, the number of ERC’s shall remain the same on the property. An ERC can be transferred on the property from a structure being removed to a structure being constructed.
    Subd. 5. Uses Not On Table. Any use not represented in the ERC table shall be subject to determination of the appropriate number of ERC’s by the City based on estimated flows. The most recent edition of the Service Availability Charge Procedures Manual prepared by the Metropolitan Council Environmental Services division may also be utilized as a tool for calculating ERC’s.”
    SECTION TWO. That this ordinance shall take effect and be in force on March 1, 2013.

    AN ORDINANCE AMENDING ORDINANCE ESTABLISHING WATER RATES AND REGULATIONS FOR WATER SERVICES, PROVIDING FOR THE COLLECTION THEREOF, AND REQUIRING HOOKUP TO MUNICIPAL LINE.

    WHEREAS, the City Council of the City of Lewisville has ordered a Water Improvement Study and a Water Rate Study to determine the cost of future improvements and rates to support the improvements and operation of the water system, and
    WHEREAS, it has been determined by the Lewisville City Council to increase the Water Accessibility Charge (WAC), Base Water Fee and the Water Rates; and
    THE CITY OF LEWISVILLE DOES ORDAIN:
    SECTION 1, A and B, and 1 and 2 of Section 1, and D. of Section 2 of City of Lewisville Ordinance No. 61 is hereby amended to read as follows:
    SECTION 1: WATER AVAILABILITY AND USE CHARGES.
    A. Water Rate and Water Availability Charge (WAC) Table: To allow for current and future water system improvements that is based on a Water System Study provided by the City Engineer, a Water Rate Table has been provided to provide for annual rates for WAC Base Fees and Water Rates for the year 2000 through 2020 that shall be attached as a part of this Ordinance. The rates shall be automatically increased according to the schedule. The Water Rate Table shall be reviewed annually for consideration of changes in the WAC Base Fee and Water Rate structure.
    Page 13 of 13 - B. Availability Charge. The owner or owners of any premises to which the City water system is reasonably available shall pay an availability charge of $15.00 each month as outlined in the Water Study Table and identified within the Table as Base Fees unless and until said premises is hooked up to the City water system; at such time as said premises is hooked up to the City water system, water rates for use of the City water system shall be paid as provided in Subdivision C of this Section.
    C. Rate Schedule (Use Charge). From and after hookup of any premises to the city water system, the owner or owners of said premises shall pay for water used each month at rates fixed by ordinance of the City Council, and any rates so established may be amended at any time by duly adopted ordinance of the City Council.
    From and after hookup of any premises to the City water system, the owner or owners of said premises shall pay for water used each month at the following rates:
    1. The charge shall be a minimum fee of $15.00 per month, the charge shall be per thousand gallons $4.00, as outlined in the Water Rate Table and identified within the Table as Water Rates.
    SECTION 2. WATER LINE CONNECTIONS.
    D. Connection Charge. The connection charge imposed by the City for hookup of premises to the municipal water system shall be $75.00 as outlined in the Water Study Table and identified within the Table as WAC Fees. Such connection charge may be amended at any time by a duly adopted ordinance of the City Council. The connection charges for duplexes, townhouses, apartment buildings and other multi unit building shall be 100% of the full connection charge for each unit.
    SECTION 2. This amending ordinance shall take effect on the 25th day of February, 2013.
