    WHEREAS, there is a building located on the following described property within the corporate limits of the City of Butterfield, County of Watonwan, State of Minnesota, described as follows, to-wit:

    WHEREAS, said building(s) has deteriorated to a hazardous condition and is beyond the point of repair constituting a hazard to the public health and safety so that said building(s) must be removed or razed to abate the existing hazard.

    NOW, THEREFORE, be it resolved by the City Council of the City of Butterfield, Watonwan County, Minnesota, that the building(s) located on the above-described premises is a hazard to the public health and safety and it is hereby ordered that said building be razed and removed. WATONWAN COUNTY BOARD
SYNOPSIS OF MEETING
NOVEMBER 15, 2011

    Present:  John Baerg, Bill Berg, Mark Rentz and Scott Sanders.

    Approved the Agenda as amended.

    Approved the minutes of the November 1 regular meeting.

    Approved payment of bills as audited and filed in the County Auditor's Office as follows by fund:  General Fund-$86,688.25; Solid Waste Fund-$5,964.81; Road and Bridge Fund- $37,845.94; Ditch Fund-$10,667.73; Agency Fund-$1,008.00; and the Forfeited Land Fund-$189.63.

    Approved payment of the credit card in the amount of $589.00 and the Sheriff's card in the amount of $704.65.

    St. James Mayor Gary Sturm was present to request appointment of a County Board member to serve on the Strategic Planning Committee for Region Nine. Commissioner Sanders expressed his interest in serving.  Sturm noted that they are also looking for a Township Board representative from Watonwan County.

    Appointed Commissioner Sanders as Region Nine representative.

    Action on the MCCC Tax and CAMA contracts was delayed to the December meeting.

    Reviewed the October financial reports.

    Approved the Agreement between Minnesota Valley Action Council (Grantor) and Watonwan County Employment and Training (Provider) and accept 2012 funds available for providing services under the Minnesota Family Investment Program/Diversionary Work Program - $77,000.00, Food Stamp Employment and Training Program - $3,840.00, Supported Work Program - $7,010.00 and the Innovation Fund - $1,470.00.

    Solid Waste Officer Marge Smith reviewed the following bid results for operation of the Recycling Program on a five-year contract:

    Public Works Director Roger Risser was present to review various items.

    Ratified the appointment of Tom Braaten as a Heavy Equipment Operator.

    Risser reviewed the Road and Bridge Cash Flow Chart for August - October 2011.

    Risser reviewed the Agency Delegated Contracting Process Agreement with MnDOT.

Federal Aid has to go through MnDOT before allocation to the County.

    Adopted a "Resolution for Agency Agreement" that the Commissioner of Transportation be appointed as Agent of Watonwan County to accept federal aid funds which may be made available for eligible transportation related projects, and to authorize the Chairman and the Auditor to execute and enter into an agreement with the Commissioner of Transportation prescribing the terms and conditions of said federal aid participation.

    The following proposals were received for Engineering and Design services for replacement of Bridge #4795:

    Approved to accept the bid of Widseth, Smith, Nolting in the amount of $18,616.00, with an estimated $4,922.00 for sub-consultant fees, for a total proposal of $23,538.00, for engineering and design services on the bridge replacement project of bridge #4795 on CSAH 32 over the Watonwan River.

    Risser presented a proposed County Trail System Master Plan for future trails and links to neighboring counties' systems.

    Adopted a resolution to formerly adopt the Watonwan County Trail System Master Plan and authorizes Watonwan County Public Works undertake efforts to aid in trail system recognition and continuity and to coordinate with local businesses and organizations in promoting and marketing trails in Watonwan County.

    Discussion was held regarding CSAH 16 reconstruction from TH 60 to CR 3, and whether to go around or through Grogan. Commissioners Rentz and Baerg volunteered to meet with Risser to discuss this issue.

    Approved step increases for David Forsyth and Heidi Engel.

    Reviewed a request to remove disciplinary action from an employee's personnel file and have the action overturned.  By general consensus, the Board agreed to change dates in the letter, but not to overturn the action or remove from the personnel file.

    Reviewed Joint Powers Agreements between the Bureau of Criminal Apprehension and the County for access by the County Sheriff's Department and County Attorney's Office to Criminal Justice Data at a fee of $1560.00 per year.

    Adopted the "Resolution Approving State of Minnesota Joint Powers Agreements with
the County of Watonwan on Behalf of its County Attorney and Sheriff.

    Approved the Chairman's signing of the revised Agreement for Dispatch Services with the City of St. James.

    Closed the meeting pursuant to M.S.  13D.03, subd. 1 to discuss labor negotiations proposals.

    Opened at 12:15 PM.

    Approved 3-1 with Baerg opposed, to offer the LELS bargaining units 0% with step for 2012, 1% on July 1 plus steps for 2013, and 3% with steps for 2014, and to approve allowing the Dispatchers unit to merge with the Detention Officers.  It was also requested that members move to the $3,000 VEBA by 2014.

Authorized County Auditor Don Kuhlman to pay year-end bills.

    I.S. Director Greg Walsh was present to discuss the Email Services Agreement with Cottonwood County to provide them with Exchange Server email services.  He negotiated 95 e-mail boxes at $8.35 per mailbox the first year, $9.00 the second year, and $9.50 the third year. 
An agreement was presented to the City of St. James at $8.35 per year for 3 years for 10 mailboxes.

    Authorized the Chairman’s signing of the Email Services Agreements with the City of St. James and Cottonwood County when approved by the entities.

    Walsh reported that the City of St. James is collaborating with the County for the CivicPlus Website.  St. James requested a 90-day notification from the County if the County plans to end the agreement with CivicPlus.

    Approved the Memorandum of Agreement with the City of St. James as requested.

    Victim/Witness Coordinator Melissa Cornelius was present regarding renewal of the Grant Agreement for Ongoing Crime Victim Services 2012, in the amount of $42,309.00 for the period from October 1, 2011 to September 30, 2012.  This reflects a small decrease from the last Agreement.  The County contributed approximately $3,400.00 towards the program for 2011.

    Adopted the Grant Agreement with the Minnesota Department of Public Safety for the Victim/Witness Program.

    Approved a one-step pay increase for Kristofer Thompson.

    Approved the request of Sara Carlson for a one-year renewal of her phased retirement agreement, at 15 hours per week or less.

    Approved adjusting the comparable worth points as recommended by Bjorklund Compensation Consulting to recognize the working conditions of certain classifications.

    Approved the bargaining agreement with the AFSCME Highway union at 0% with steps for 2012, 1% on July 1, 2013 plus steps, and 3% with steps for 2014, plus a lump sum VEBA contribution of $306.00 on June 30, 2012 for changing to the VEBA high deductible plans.

    Public Works Director Roger Risser reviewed the summary of Authorized Work for Others.
Approved advertising to accept bids for the following bridge and culvert replacement projects:  SAP 83-604-10 - CSAH 4 over the North Fork Watonwan; SAP 83-610-040 - CSAH 10 over Long Lake Outlet; and SAP 83-598-021 - CR 107 over Tributary to Perch Creek.

    Approved the FEMA Project Completion and Certification Report, Disaster: FEMA - 1941-DR-MN.
Authorized the Chairman’s signing of the FEMA Certification.

    Risser reviewed proposed changes to the Public Works Fee Schedule, including increases in Entrance Construction, Local, State or Federal Aid Plans and Proposals, Transportation Permits, and Fairgrounds Storage.

    Approved the Public Works Fee Schedule as proposed.

    Risser reviewed a MN/DOT Detour Agreement for the State’s use of CSAH 18 as a detour during construction on TH 4 for a fee of $1,771.49.
Adopted a resolution to enter into Mn/DOT Agreement No. 00344 with the State of Minnesota, Department of Transportation to provide for payment by the State to the County for the use and maintenance of Watonwan County State Aid Highway 18 to be used as a detour route during the contract construction to be performed upon, along and adjacent to Trunk Highway No. 4 located 5.9 miles north of St. James and 7.2 miles north of St. James under State Project No. 8302-33 (T.H. 4).
Risser requested approval of the Bridge Guard Rail Force Account for guardrail improvement on three bridges in the County.

    Approved the Bridge Guard Rail Force Agreement for SAP 83-030-090, for guardrail improvements on BR #92417, BR #90344 and BR #90330.
Solid Waste Officer Marjorie Smith was present to request permission for Highway Department staff to build a St. James Recycling Shed on the Fairgrounds.  It would be 12 X 24 and built on runners so it can be moved during the Fair.  

    Approved construction of a recycling shed at the Fairgrounds.
Commissioner Baerg reported that the Association Minnesota Counties (AMC) changed committee appointment procedures so that each county must have at least one member appointed to a policy committee.  By general consensus the Board made the following appointments to the AMC Policy Committees: Health and Human Services - Commissioner Baerg, Transportation - Commissioner Sanders, General Government - Commissioner Gustafson, Public Safety - Commissioner Berg; and Environmental and Natural Resources - Commissioner Rentz.
Commissioner Sanders noted that he has several conflicts on the meeting dates for Region 9, and Commissioner Gustafson would be willing to replace him.  

    Approved the appointment of Commissioner Gustafson as the Region 9 representative.

SYNOPSIS OF MEETING
DECEMBER 8, 2011

    Present:  John Baerg, Bill Berg, Raymond Gustafson, Mark Rentz and Scott Sanders.
Raymond Gustafson was sworn in as the new First District Commissioner by County Auditor Donald Kuhlman.

    Approved the Agenda as amended.

    Approved the minutes of the November 15 regular meeting.

    Joint Watonwan/Martin Ditch Redetermination of Benefit Hearings for JD 2 and JD 4 were scheduled for January 17, 2012 at the Ormsby Fire Hall.  Chairman Rentz appointed Commissioners Baerg and Sanders for JD 4 and Commissioners Baerg, Sanders and Rentz for JD 2.

    Ratified the MCCC Support Contracts with ACS for the CamaUSA and Property Tax System Maintenance, and support for the County Attorney’s software (MCAPS).

    Approved to authorize the Chairman’s signing of the “Limited Disclosure Dissemination Agent Agreement” with Northland Securities, Inc. to fulfill reporting requirements at a fee of $435.00.

    Approved payment of Boat Grant Expenditures to Gall’s - $1084.68 and Beezy’s Custom Design - $296.04 and the DVR bill from Security Products Company - $4563.96.

    Approved the Emergency Management Performance Grant Agreement for 2011 in the amount of $15,501.00.

    Approved the training requests submitted by Roger Risser, Carol Johnson, Donald Kuhlman and Joy Sing.
County Auditor Donald Kuhlman reviewed the November 2011 financial reports.

    A budget meeting was scheduled for 1:00 P.M. on December 20 with final budget and levy to be set on December 27 at 9:00 A.M.

    Corrections Officer Paul Harris was present regarding a shared half-time position with Human Services for Family Preservation, with the objective to abate correctional out-of-home placements.  It was approved by the Human Services Board with the understanding to pay one quarter of the costs from the Court Services budget, in the amount of $12,000.

    Approved increasing the Court Services budget by $12,000 to reflect the shared position with Human Services.
Harris reported that Les Schultz proposed reducing the Intensive Supervision position to half-time at a cost to the County of $22,250.00 per year, noting that Watonwan will be unable to participate in the juvenile drug court.
Public Works Director Roger Risser was present to review items.

    Approved to accept completed Contract No. 2720 and approve final payment to Knife River Corp. for SP 83-627-020 for CSAH 27 overlay.

    Risser requested adoption of resolutions relating to the Watline Trail (Stage II) project.
Adopted a resolution that Watonwan County agrees to act as sponsoring agency for a “Transportation Enhancements” project identified as the Watline Trail and has reviewed and approved the project as proposed.  Sponsorship includes a willingness to secure and guarantee the local share of costs associated with this project and responsibility for seeing this project through to its completion, with compliance of all applicable laws, rules and regulations.

    Adopted an agreement that the sponsoring agency will assume full responsibility for the operation and maintenance of property and facilities related to the aforementioned enhancement project.

    Risser reviewed an application for Local Road Improvement Program funds for paved shoulders and rumble stripes on County Road 5 from Butterfield to State Highway 30.

    Adopted a Resolution for Agreement to State Transportation Fund Local Road Improvement Program Grant Terms and Conditions, the amount of the grant has been estimated to be $350,000, and agreeing to pay any additional amount by which the cost exceeds the estimate, and will return to the Minnesota State Transportation Fund any amount appropriated for the road project, but not required.
Sheriff Gary Menssen requested that the St. James Baseball Association be able to lease the roller rink building at the Fairgrounds for batting practice.

    Approved the Agreement with the St. James Baseball Association for rental of the roller rink building in the amount of $500.00 per year.
Discussion was held regarding the CodeRED high speed notification and weather warning systems.  The Board requested commitment from the Cities of St. James and Madelia to each pay one quarter of the cost before taking action.
Sheriff Menssen reviewed Motorola’s proposal for 800 MHZ radios and equipment for law enforcement, the Highway Department and city maintenance departments in the amount of $90,000.41.

    Approved the purchase of the radio equipment from Alpha Wireless Communications in the amount of $90,000.41.
Approved the satisfactory completion of probationary periods by Jennifer Sweere, Tamara Colón and Jan Grunig.

    Approved a one-year step increase for Janet Starks.
Approved hiring the top finalist for the Madelia Branch Library Assistant position pending acceptance of the position and completion of reference checks.

    Approved paying Charlie Beckius out of class until the Highway Maintenance Supervisor returns.

    Authorized the Chairman’s signing of the Board of Water and Soil Resources Natural Resources Block Grant Agreement for funding in the total amount of $63,636.00 for the following Base Grants: Comprehensive Local Water Management, Wetland Conservation Act, DNR Shoreland Management, MPCA County Feedlot, and MPCA/BWSR SSTS.

    Discussion was held regarding the Sentence to Serve Program.
Closed at 3:30 pursuant to MS 13D.05, Subd. 3(b), for attorney-client privilege related to pending litigation involving County property.
Opened the meeting at 3:50 P.M.

    Approved hiring Charles Lane of Environmental Process, Inc. as an expert witness in upcoming litigation involving County property.

DECEMBER 27, 2011

    Present:  John Baerg, Bill Berg, Raymond Gustafson, Mark Rentz and Scott Sanders.
The Board met to set the 2012 budget and tax levy along with adjustments to the non-union salary schedule and to set Department Head and elected official salaries for 2012.

    Adopted a resolution that the annual salary for Watonwan County Commissioners for 2012 shall be set at a base of $18,850 (3.6%).  In addition, the Chairman of the County Board shall receive an additional $520.00; that each member of the Board of County Commissioners shall receive per diem payment of $50.00 for four hours or less, including travel, $75.00 for over four hours, including travel or two meetings in a day, and $ 100.00 for Human Services Board per diems, and that each member shall be allowed mileage and expense reimbursement in accordance with County Policies in connection with service on the Board committees or commissions; and services provided relating to departmental appointments, road and ditch inspections within the Commissioner’s district and other duly authorized committees established after the date of this resolution.

    Approved to increase the non-union salary schedule for 2012 by 3%, provide step movement on applicable anniversary dates to those employees that would have been eligible for step movement in 2010 and new hires that would be eligible after completing their probation, and to set the 2012 salaries of appointed officials as follows:
