Labor Rates- Minimum Wage Requirements:
This project is being funded by the Minnesota Public Facilities Authority’s Drinking Water Revolving Loan Fund and the  City of St. James, Minnesota.  The project is subject to the State of Minnesota and Federal minimum wages.

Performance and Payment Bonds:  The successful Bidder will be required to furnish a Performance Bond and Labor and Materials Payment Bond each in the amount of the Contract.

The Bid, Agreement, and Bonds shall be conditioned upon compliance with all provisions of the Bid Documents.

PROJECT ADMINISTRATION:  All questions relative to this project prior to the opening of bids shall be directed to the Engineer/Manager for the project.  It shall be understood, however, that no specification interpretations will be made by telephone.

A. Call to Order:
    Chairperson Brown called the meeting to order at 5:30 p.m.

B. Roll Call by the Clerk:
    Members Present: Anderson, Brown, Firchau, Mohlenbrock, Pinke, Stevens
    Member Absent: Reuter, Student Rep.

C. Preview & Approve Agenda
    Member Pinke moved, second by Member Anderson to approve the amended agenda. Motion was approved 6-0.

D. Consent Items
    Member Stevens moved, second by Member Mohlenbrock to approve the minutes from the Nov. 9th regular meeting and the Nov. 23rd special meeting. Motion was approved 6-0.

E. Bills and Payments
    Member Mohlenbrock moved, second by Member Firchau to approve the bills and payments as presented, totaling $1,072,281.32. Motion was approved 6-0.

F. Receive Visitors
    Youth counsel presented to the board on the integration grant they were awarded and also the posters that they created.
    Chairman Brown recessed the Regular Meeting at 6:05 p.m. and called to order the Agenda for the 2010 Tax Hearing at 6:05 p.m.
    Member Stevens moved, second by Member Mohlenbrock to approve the agenda. Motion was approved 6-0.
    Nordy Nelson presented to the board and audience the prepared 2009/2010 Levy Limitation and Certification. Discussion by the board ensued.
    Member Stevens moved, second by Member Mohlenbrock to approve the final Levy at $1,215,700 for District #840. Motion was approved 6-0.
    Chairman Brown adjourned the Tax Hearing meeting at 6:12 p.m.
    Chairman Brown re-opened the Regular Meeting at 6:12 p.m.

G. Old Business
    Member Mohlenbrock moved, second by Member Stevens to approve a new policy titled “Home Room Size-Staffing Options”. Motion was approved 6-0.
    Member Pinke moved, second by Member Firchau to approve a new policy titled “Textbooks and Instructional Materials.” Motion was approved 6-0.
    Member Firchau moved, second by Member Stevens to approve a new policy titled “Alternative Programs.: Motion was approved 6-0.

H. New Business
    Member Mohlenbrock moved, second by Member Anderson to approve a first reading of a proposed policy titled “Disposition of Obsolete Equipment.” Motion was approved 6-0.
    Member Anderson moved, second by Member Firchau to direct Chairman Brown to appoint a committee to review and discuss an arrangement with District Booster Clubs. Chairperson Brown appointed Members Pinke, Stevens, and Mohlenbrock. Motion was approved 6-0.
    Member Mohlenbrock moved, second by Member Anderson to approve a public meeting  to review district options for administrative coverage and for advertising of the meeting. Motion was approved 6-0.
    Member Pinke Moved, second by Member Mohlenbrock to approve a Budget and Programming review for the remainder of the 2009-2010 school year. Motion was approved 6-0.
    Member Pinke moved, second by Member Anderson to approve new work agreements for Jan Crissinger-Clark, Musical Assistant; Jeff Whitney, Wrestling Coach; Melanie Johnson and Lee Ann Petterson, paraprofessionals. Motion was approved 6-0.

I. Other Business
    Member Stevens moved, second by Member Pinke to approve the new Teacher Agreement for 2009-2011. Motion was approved 6-0.

J. Reports
    Member Firchau reported that there was no change in numbers for our River Bend Ed. District enrollment and also that no meeting would be held in December.
    Supt. Nelson reported to the Board on area search firms available to the district in finding a Superintendent.

K. Adjournment
    Member Anderson moved, second by Member Firchau to adjourn the meeting at 6:55 p.m. Motion was approved 6-0.

WATONWAN COUNTY BOARD
SYNOPSIS OF MEETING
DECEMBER 15, 2009

    Present:  John Baerg, Bill Berg, Dwayne Krenz, Mark Rentz and Scott Sanders.
    Approved the minutes of the December 1, 2010 regular meeting, December 3 Truth in
Taxation Public Hearing, and the December 4 special meeting.
    Approved the Agenda as amended.
    Approved payment of bills as audited and filed in the County Auditor's Office as follows by fund:  General Fund-$166,813.36; Solid Waste Fund-$3,968.77; Ditch Fund-$9,803.07 and the Forfeited Land Fund-$1,113.49.
    Emergency Management Director Julie Peterson was present regarding the Emergency Operations Plan.  The Plan gets reviewed every year on a rotating cycle by the State, peers, regional board and County Board.  Commissioner Baerg has reviewed the plan and commented on the increasing requirements each year.
    Approved the Chairman's signing of the Emergency Operations Plan.
    Reviewed the Disbursements listing for October and November 2009.
    Approved the training requests submitted by Roger Risser, Carol Johnson and Joy Sing.
    County Auditor Donald Kuhlman reviewed the financial reports for November 2009.
    Adopted the South Central Workforce Service Area Joint Powers Agreement as revised utilizing the Minnesota Counties Insurance Trust (MCIT) model.
    Approved the Agreement between Minnesota Valley Action Council (Grantor) and Watonwan County Employment and Training (Provider), for providing services under the Personal Responsibility and Work Reconciliation Act, Food Stamp Employment and Training Program and the Supported Work Program.
    Approved payment of credit card bill in the amount of $569.51 and Sheriff's credit card.
    Auditor Don Kuhlman reviewed the 2010 proposed levy and budget to include the use of $183,000 of fund balance.
    Adopted the 2010 budget and to set the 2010 Property Net Tax Levy at $7,067,044, a 3.7% increase, as follows by fund:

    Approved setting County Attorney LaMar Piper's salary for 2010 at $83,262.40.
    Approved setting County Auditor Don Kuhlman's salary for 2010 at $76,585.60.

    Approved setting County Sheriff Gary Menssen's salary for 2010 at $67,662.40.
    Sheriff Gary Menssen was present to review recommendations of a consultant to conduct the Participation Plan for the ARMER system.  The following proposals were received: GeoComm - $27,200.00, Paskvan - $25,500.00 (proposal rejected by the committee), Therkelson and Associates - $28,500.00, and Alpha Wireless - $12,000 to $30,000.00.  The committee recommended Alpha Wireless as the best fit because they know the County's equipment and are potentially the lowest bidder unless costs reach the maximum of $30,000, which is the grant amount.
    Approved accepting the proposal of Alpha Wireless Communications in the amount of $12,000.00 to $30,000.00 to conduct the ARMER Participation Plan.
    Public Works Director Roger Risser was present to review various items.
    Approved payment of the Road and Bridge bills as audited and filed in the County Auditor's Office in the amount of $70,031.67.
    Risser reviewed the Road and Bridge Cash Flow Chart for September to November 2009 and the report of Authorized Work for Others.
    Adopted the Road and Bridge proposed fee schedule for 2010.
    Risser reported that a beaver trapper contacted the county regarding a program to reimburse for beaver pelts where beavers are a nuisance.  Chairman Sanders requested that the individual contact the Board directly.
    Risser reviewed the dues statement from the MN Transportation Alliance in the amount of $1,490.00.  It was questioned whether the organization is valuable to Watonwan County.
    Risser was asked to check whether neighboring counties would continue their memberships.
    Further discussion was held regarding the option to adjust County State Aid Regular Construction and Regular Maintenance Allotments.  In question was adjusting the current 60/40 split to a 50/50 split which is allowed.  Based on the last two annual reports the County has spent approximately $200,000 more on maintenance, which comes out of local funds.  Commissioner Baerg expressed the need to maintain what exists and construct when it can be afforded, but other members expressed the importance of construction.  No action was taken.
    Approved setting County Treasurer Carol Johnson's salary for 2010 at $51,979.20.
    Approved setting the 2010 HRA Levy at $83,102.
    Approved maintaining the recycling fee schedule at $5.75 per unit.
     The Board reviewed the proposed fee schedule.  There was a question on charging for burning permits.  Sheriff Gary Menssen was asked to the meeting and clarified that it is up for discussion at the regional sheriff's meeting.  They also discussed jail meals, and pay-to-stay fees with Sheriff Menssen.  By general consensus, the Board agreed that the burning permit is a safety issue, and shouldn't have a fee attached.
    Approved the fee schedule as reviewed.
    Approved the appointment of Virginia Thiessen to the position of Darfur Branch Library
Attendant.
    Approved a pay increase for Paul Luther for the satisfactory completion of his probationary period.
    Approved one-step pay increases for Diane Englin and Michelle Svalland.
    Approved freezing non-union salaries for 2010 and to delay step movement currently scheduled for 2010 or 2011 for one year each, excluding employees completing their first full step following probation.
    It was noted that the Library budget did not include closing the libraries one day a month.
    Approved designating the Madelia Times-Messenger and the St. James Plaindealer as the first and second legal newspapers respectively for 2010.
    Adjourned at 11:50.
