A search warrant was executed at the residence of 123 7th Ave. S., St. James, on May 20th, 2009. Police Chief Mark Carvatt says his department assisted the Minnesota Bureau of Criminal Apprehension (BCA) in the matter. He also said the search had both departments at the residence for two hours and that it is an “ongoing investigation.”
The Plaindealer obtained a copy of the search warrant. It states the following:
The copy states that on 4-14-09, Officer Dale Hanson from the Minneapolis Police Department identified a Minnesota computer offering to participate in the distribution of child pornography. Officer Hanson, who is an affiliate with the Minnesota Internet Crimes Against Children (MNICAC) Task Force, connected with the computer by using its IP address and learned 60 or more files had been identified as known or suspected child pornography. Hanson further identified four files the suspect/host computer had in its share folder that were child pornography.
According to a copy of the search warrant, an administrative subpoena was sent to Mediacom, the Internet Service Provider to this IP address. Mediacom stated the subscriber was Jose Gonzalez, with an address of 123 7th Ave. S., St. James, Minnesota.
May 2009 rental records provided by Assistant Chief Rick Eisfeld from the St. James Police Department show Rocio Gonzalez as the landlord for 123 7th Ave. S. and Guadalupe Rios as the tenant, states a copy of the search warrant.
Special Agent (SA) Janette May works for the BCA and is a head investigator in this case; she also made the application for the search warrant. According to a copy of the search warrant, on 5-19-09 SA May spoke to Officer Hanson who said since his original undercover investigation, the IP address was “getting larger” and it “contains more child pornography files than what was originally reported.”
SA May used a government research tool called Accurint which stated the current residents of 123 7th Ave. S. were Guadalupe Rios and Doyle Lunz. Lunz is a predatory offender and has been incarcerated since 2-10-08 for sexually assaulting two teenage girls. In that sexual assault complaint, Kimberly Gonzalez is listed as Lunz’s sister. On August 4th 2007 Kimberly Gonzalez moved into 123 7th Ave. S., all this according to a copy of the search warrant provided by the Watonwan County Court Administrators.
This brings us back to May 20th, 2009, the date the search warrant was executed. On the evidence receipt, in a box titled “Name of Person From Whom Property is Obtained,” the name of Jose Gonzalez is written. The property relinquished includes three computer towers, two laptops, two hard drives, two flash drives, six disks, and a bag containing miscellaneous paper work.
No arrests have been made as of Wednesday, July 1st.
