2010 Raw Water Improvements

RECEIPT AND OPENING OF PROPOSALS:  Sealed proposals for the work described below will be received by the City Administrator at the City of St. James, City Hall, 124 Armstrong Boulevard, South, St. James, MN  56081 until 10:00 a.m. on March 4, 2010  at which time the bids will be opened and publicly read.

DESCRIPTION OF WORK:  The work includes the following:
    Furnish and install approximately 10,000 LF of 14-inch HDPE raw watermain.
    Furnish and install eleven (11) precast concrete vaults with valves and pipe fittings.
    Furnish and install 150 LF of casing.
    Furnish and install 100 LF of 6-inch watermain and six (6) hydrants.
    Furnish and install two (2) vertical turbine pumps.
    Furnish and install two (2) air cushioned swing check valves and one (1) gate valve.
    Furnish and install one (1) magnetic flow meter.
    Furnish and install four (4) variable frequency drives.
    Provide miscellaneous electrical wiring and control modifications.

COMPLETION OF WORK:  All work under the Contract must be complete within One Hundred Eighty (180) calendar days after receipt of the Notice to Proceed.

OBTAINING CONTRACT DOCUMENTS AND BIDDING REQUIREMENTS:  Plans and specifications and all contract documents may be obtained at the office of Bolton & Menk, Inc., 1960 Premier Drive, Mankato, MN 56001, upon payment of $75.00, (includes sales tax; non-refundable) for each full set of specifications and accompanying drawings. Additional shipping charges will apply for delivery to any address not within the lower 48 states.

BID SECURITY: A certified check or a Bid Bond satisfactory to the City of St. James, Minnesota, in the amount of not less than 5 percent of the total Bid price submitted must accompany each Bid.

Labor Rates- Minimum Wage Requirements:
This project is being funded by the Minnesota Public Facilities Authority’s Drinking Water Revolving Loan Fund and the  City of St. James, Minnesota.  The project is subject to the State of Minnesota and Federal minimum wages.

Performance and Payment Bonds:  The successful Bidder will be required to furnish a Performance Bond and Labor and Materials Payment Bond each in the amount of the Contract.

The Bid, Agreement, and Bonds shall be conditioned upon compliance with all provisions of the Bid Documents.

PROJECT ADMINISTRATION:  All questions relative to this project prior to the opening of bids shall be directed to the Engineer/Manager for the project.  It shall be understood, however, that no specification interpretations will be made by telephone.

St. James Wastewater Treatment Facility Improvements

    Minimum Contractor Qualifications: Bidder shall have experience as a general contractor in the successful completion of at least 3 municipal wastewater treatment facilities in the last 8 years with a minimum design average flow of 1 million gallons per day. The 3 projects must include the following construction experience: new building construction, earthwork, concrete work, process piping and valves, wastewater process equipment, electrical, HVAC, and instrumentation and controls. Bidder shall list experience on Bid Form under Project References.
A Pre-Bid Conference will be held at 10 A.M., CST on Tuesday, February 9, 2010 at the St. James Wastewater Treatment Facility, located at 1305 Weston Avenue North, St. James, MN 56081. ORDINANCE OF THE CITY OF ST. JAMES AMENDING SECTION 6.32, SUBD. 2, AS IT APPLIES TO LICENSE REQUIRED IN REGARDS TO THE ST. JAMES RENTAL HOUSING ORDINANCE

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ST. JAMES SUBD. 2 OF SECTION 6.32 OF THE CITY CODE SHALL BE AMENDED TO READ AS FOLLOWS:

Subd. (2). License Required.

    A. It is unlawful for any person, as the owner, manager or other person having control of any dwelling unit, to lease, rent, offer for rent or lease, or permit to be leased, rented or offered for rent or lease, or permit the occupancy of any dwelling unit as defined in this Section with the license for such dwelling unit as hereafter provided.

    B. It shall be unlawful for any person to occupy a dwelling unit within the City that is found to be in violation of the Subdivision.

    C. A rental license shall be required in the following situations:

    (i). A dwelling unit is rented or leased as defined by this Chapter; or

    (ii) A dwelling unit is not occupied by the owner, but is occupied by one or more persons that are unrelated to the owner of said unit; or

    (iii) A dwelling unit is occupied by the owner and one or more persons unrelated to the owner. An owner occupying a dwelling unit with one unrelated person under the definition of Family-Functional shall  not be required to obtain a rental license provided the property is not rented or leased as defined by this Chapter.

    (iv) A dwelling unit is not occupied by the owner, but is occupied by a person or persons related by blood to the owner and one or more persons that are unrelated to the owner.

    Residential occupancies shall conform to all of the requirements of the St. James City Code, including but not limited to Section 11.20 and 11.21.

    D. For purposes of determining occupancy for rental purposes, the following standards shall apply:

    (i) The term “Unrelated” shall mean individuals who are not related by blood, marriage or adoption. For the purposes of this Chapter, “related by blood” shall mean whole or half relation between a common ancestor or descendant, husband, wife, son, daughter, father, mother, brother, sister, uncle, aunt, niece, nephew, stepchildren, stepfather, stepmother, legally adopted children, grandmother, grandfather, state assigned foster children, first cousin or any combination of the above persons.

    (ii) An occupant is a person that occupies a dwelling unit for living and/or sleeping purposes for more than seven (7) days in a consecutive thirty (30) day period.

    (iii) A guest may occupy a licensed or unlicensed dwelling unit provided the guest does not reside in the dwelling unit for more than seven (7) days within a consecutive thirty (30) day period and the guest has a documented permanent residence other than the dwelling unit in which they are considered a guest.

    (iv) The occupancy of a dwelling unit shall comply with the occupancy restrictions of the residential districts as stated in Section 11.20 and 11.21 of the St. James City Code.

    This Ordinance shall become effective upon the date of publication.

    Adopted by the City Council of the City of St. James, this 19th day of January, 2010.
